LAS VEGAS - Democratic presidential rivals and their supporters vied for advantage in the courts, on a debate stage and at the ballot box on Tuesday in an unsettled race for the party's nomination to the White House.

The debate lineup included Sens. Hillary Rodham Clinton of New York and Barack Obama of Illinois as well as former Sen. John Edwards, but Tuesday evening the Nevada Supreme Court rejected an effort by Ohio Rep. Dennis Kucinich to join in, too.

LAS VEGAS – NBC News said it will appeal a judge's ruling rather than include Democratic presidential candidate Dennis Kucinich in a candidates' debate Tuesday in Nevada.

“We disagree with the judge's decision and are filing an appeal,” said a statement provided for the network by Jeremy Gaines, a communications vice president for MSNBC. He said the network would seek an immediate hearing before the Nevada Supreme Court.

Congressman Dennis Kucinich, weary from a dozen campaign stops in a week, sat in a small room at the Monterey fairgrounds on Sunday, but he had a look in his eyes that said he knew he wouldn't sit for long. Still, his expression seemed to lighten as he recalled his comedic success last week as a guest on The Colbert Report, the farcical news show on "Comedy Central."

"The secret of it," he said, pausing for effect, "Don't try to be funny."

Only then did he let out a laugh.
